Conditions of participation:

These conditions of participation apply to participation in the Instagram competition campaign "le melo Hydration" by le melo (hereinafter: "campaign"), which is organized by le melo Sportnahrung GmbH (hereinafter "le melo"). By participating in the campaign, participants agree to the conditions of participation. In order to take part in the promotion and win 1 of 5 packages, each consisting of the le melo trial package, the following conditions apply:

1. Participation and processing:

Campaign period: 08/10/2022 to 08/17/2022.
Closing date for entries: August 16, 2022, 11:59 p.m.
Eligibility: All persons who have reached the age of 18 and are resident in Germany are eligible to participate. Excluded are employees of le melo and employees, as well as their relatives.

Determination of profit and profit:
5 winners will be chosen at random from all participants.
The winners will be personally notified by le melo in the comments section and asked to send their contact details (surname, first name, address within Germany) via Instagram direct message.
After contacting le melo, the winners must send their contact details (surname, first name, address within Germany) via Instagram direct message so that the prize (le melo trial package) can be sent at the expense of le melo. If le melo does not provide the contact details or confirm acceptance of the prize within 3 days after contacting le melo, the prize will be forfeited. If the prize expires or is not accepted, this prize will be raffled among all participants.

Multiple wins are excluded.
Exclusion of payment of the prize: A payment of the prize other than specified, eg in cash, is excluded.
Exclusion for participation via external links: Participation in the competition is excluded if the person concerned did not access the competition on Instagram directly via Instagram, but was forwarded to Instagram from a third competition page.

3. Instagram Rules of Conduct
The term "content" used below means all content posted and communicated by the participants as well as information such as photographs, graphics, videos, texts, comments, information about places and people as well as links.

Responsibility: The organizer le melo is not responsible for the behavior of the participants and the content published by the participants as part of the campaign and does not adopt these as their own. Furthermore, the organizer is not obliged to check them, but reserves the right to reverse their publication if there are concrete indications that the content violates legal requirements, official prohibitions, the rights of third parties or morality. The same applies to disparaging le melo products or brands.

Third-party rights: Participants must ensure that the content they post as part of the campaign is free of third-party rights and does not infringe any third-party rights (copyrights, personal rights). The participants must therefore ensure that they have the consent of the third party, in particular if the participants post or send in photos on which third parties can be seen.

Harassment of third parties: Participants must refrain from harassing other people in the context of the campaign, for example by using notification, forwarding or sharing functions for sending messages if it can be expected that the recipients will not want them to be received .
Release: If claims are made against le melo for illegal content, infringement of third-party rights or other violations of the law for which the participants are responsible, the respective participants hereby release le melo from all third-party claims and support le melo in defending against the claims .

4. Use Rights
Granting of rights: The participants grant le melo the non-exclusive right to reproduce, distribute, make publicly accessible, exhibit, process in any technical way, and transfer these rights to third parties, such as technical service providers.
Consent: The participants agree that their photos or contributions to the campaign, names and Instagram account names in connection with the campaign, the draw, processing or presentation of the participant contributions will be publicly known by le melo or the commissioned third parties in online media are given.

5. Privacy Policy
The collection, processing and use of the personal data of the participants takes place exclusively in compliance with the relevant data protection regulations and for the provision, implementation and processing of the campaign.

6. Liability and Other Provisions
le melo is released from all obligations when the prize is handed over, unless an earlier point in time results from these regulations.
le melo assumes no liability for legal and/or material defects. le melo is not liable for any personal injury, property damage and/or financial loss arising in connection with this agreement, unless the damage was caused intentionally or through gross negligence (in the case of personal injury intentionally or negligently) by legal representatives or vicarious agents of le melo.
Exclusion of participation: le melo reserves the right to exclude participants who manipulate the campaign, disregard the rules of conduct, provide false information or violate the conditions of participation from participating in the campaign at any time and without prior notice. In the event of an exclusion, prizes and benefits can also be subsequently revoked and reclaimed.
le melo assumes no liability for data loss in the course of data transmission and other technical defects that are within the sphere of influence of the participant.
The law of the Federal Republic of Germany is the exclusive applicable law.
Should any of these provisions be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
